Agreement to these terms
These Terms of Use ("Terms") govern your access to and use of the Townssy website, mobile experience, and related services (collectively, the "Service"). By creating an account, browsing listings, or placing an order, you agree to these Terms.
If you do not agree, you must not use the Service. We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Your continued use after changes become effective constitutes acceptance of the revised Terms.
Townssy as a marketplace
Townssy operates an online marketplace that connects buyers with independent sellers and service providers. Unless we clearly state otherwise on a product or checkout page, Townssy is not the seller of record for third-party listings.
Sellers are responsible for the accuracy of their listings, lawful fulfilment, and compliance with applicable consumer and trade laws. Townssy provides the platform, payment facilitation, and related tools, but does not guarantee the quality, safety, or legality of items offered by sellers.
Accounts & eligibility
You must be at least 18 years old and able to enter a binding contract to use the Service. You agree to provide accurate registration details and to keep your login credentials confidential.
- You are responsible for all activity that occurs under your account.
- You must notify us promptly if you suspect unauthorized access.
- We may suspend or close accounts that violate these Terms, create risk, or remain inactive for an extended period.
- One person may not maintain multiple accounts to evade restrictions, abuse promotions, or mislead other users.
Orders, pricing & payments
Product and service prices, descriptions, stock levels, and delivery options are set by sellers and may change without notice until you complete checkout. By submitting an order, you authorize us to charge the total amount shown, including applicable discounts, delivery fees, and taxes where required.
- Payments are processed through approved providers such as Paystack. You must use a payment method you are authorized to use.
- An order is not confirmed until payment is successfully authorized or completed, depending on the payment flow shown at checkout.
- We and sellers may refuse or cancel orders for suspected fraud, pricing errors, stock unavailability, or policy violations.
- Promotional codes are subject to their stated conditions and may be withdrawn or corrected if applied in error.
Delivery, pickup & fulfilment
Delivery timelines, regions served, and pickup options depend on the seller, product type, and your selected address. Estimated delivery dates are not guaranteed unless expressly stated on the order confirmation.
You are responsible for providing a valid delivery address and being available to receive items where required. Risk of loss may pass to you upon delivery to the address provided or upon pickup confirmation, depending on the order type and applicable law.
Cancellations, returns & refunds
Unpaid orders may be cancelled according to the options shown in your account. Paid orders are subject to seller fulfilment rules, delivery status, and Townssy's refund settings.
- Refunds, where approved, are generally returned to the original payment method unless we state otherwise.
- Return eligibility may vary by product category, hygiene restrictions, digital goods, or custom-made items.
- If an item arrives damaged, incorrect, or not as described, contact us promptly through the order help flow so we can review the case.
- Chargebacks or payment disputes should be raised through Townssy first where possible so we can investigate before involving your bank.
Acceptable use & prohibited conduct
You agree not to misuse the Service. Prohibited conduct includes, without limitation:
- Posting false, misleading, infringing, or unlawful content.
- Attempting to manipulate reviews, prices, search results, or promotions.
- Harassing, threatening, or impersonating other users or Townssy staff.
- Scraping, reverse engineering, or overloading our systems without written permission.
- Circumventing payment, identity, or security controls.
- Using the Service for money laundering, fraud, or any illegal purpose.
We may remove content, withhold payouts, restrict features, or terminate access when we reasonably believe these rules have been violated.
Reviews & user content
You may submit reviews, messages, photos, and other content through the Service. You retain ownership of your content, but grant Townssy a non-exclusive, worldwide, royalty-free license to host, display, and use it for operating and promoting the marketplace.
Reviews must reflect genuine experiences. We may remove reviews that are abusive, incentivized without disclosure, or clearly unrelated to a verified purchase where verification applies.
Intellectual property
The Townssy name, logo, site design, software, and other platform materials are owned by Townssy or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform materials except as allowed by these Terms or with our prior written consent.
If you believe content on Townssy infringes your rights, contact us at info@townssy.com with sufficient detail for us to review the claim.
Disclaimers & limitation of liability
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Townssy disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
Townssy is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the Service or any transaction between users. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid Townssy for the relevant order in the three months before the claim or one hundred Ghana cedis (GHS 100), except where applicable law requires otherwise.
Changes, termination & governing law
We may modify, suspend, or discontinue any part of the Service at any time. You may stop using the Service at any time. Sections that by nature should survive termination will remain in effect, including payment obligations, disclaimers, and limitations of liability.
These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles. Disputes should first be raised with our support team. Where courts have jurisdiction, claims shall be brought in Ghana unless mandatory consumer protection rules in your country provide otherwise.
Our handling of personal data is described separately in the Privacy Policy. That document explains what we collect and how we use it; these Terms govern your contractual relationship with the marketplace itself.
